The Direct Menswear $100 Gift Card Giveaway Official Rules
Participation constitutes participant's full and unconditional agreement to and acceptance of these Official Rules. The Direct Menswear $100 Gift Card Giveaway ("Giveaway") begins on the first day of the month at 12:01 a.m. Eastern Time. The Giveaway ends on the last day of the month at 11:59 p.m. Eastern Time. Direct Menswear reserves the right to discontinue the contest at any time.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS $100 GIFT CARD GIVEAWAY.

By entering, each participant agrees to be bound by these Official Rules and the decisions of the contest, which shall be final. Direct Menswear reserves the right to disqualify any person that Direct Menswear determines to be in violation of any term contained in these rules. LIMIT ONE (1) ENTRY PER PERSON. THE GIVEAWAY IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
ELIGIBILITY
The Giveaway is open only to individuals who are registered users of the Direct Menswear mailing list, are legal residents of the 50 United States or the District of Columbia, and are 18 years of age or older at the beginning of the applicable Entry Period.
Employees of Direct Menswear and their related entities, affiliates, subsidiaries, advertising and promotion agencies, and the families of each are not eligible. Direct Menswear reserves the right to disqualify any participant who, in Direct Menswear sole discretion has circumvented or violated or attempted to circumvent or violate these Official Rules and to render void any subsequent entries of the disqualified participant.
PRIZES
One (1) participant (“winner”) each month will be selected at random to receive a $100 Direct Menswear gift card redeemable at www.direct-menswear.com. Gift card is an electronic gift card in the form of a Globally Unique Identifier number. Limit of one (1) prize per person/e-mail address. Prizes are non-transferable and non-endorsable, and no other consideration or substitution is available. Prizes are not redeemable for cash. Lost or stolen prizes cannot be replaced.
The drawings will be made by Direct Menswear, whose decisions are final with respect to all matters relating to the Giveaway. All entries are the property of Direct Menswear and will not be returned or acknowledged. The drawings will take place on or around the fifth business day of each subsequent month. Prize-winning participants will be notified by e-mail no later than the 15th day of the month. It is the sole responsibility of the participant to notify Direct Menswear in writing, referencing the Giveaway, if the participant changes his or her e-mail address by writing to giveway@direct-menswear.com. A Prize winner is solely responsible for any and all applicable federal, state, and local taxes (including where applicable, sales tax) due with respect to a Prize awarded to him/her, as well as all applicable fees and expenses related to the acceptance, award, and use of a Prize.
WINNER NOTIFICATION
The winner of the Prize will be notified via e-mail sent to the address specified in the registration. The winner will be required to respond to the e-mail to claim the Prize, and may additionally be required to sign and return a release of liability, declaration of eligibility, and where lawful, a publicity consent agreement. Notwithstanding the foregoing, except where prohibited, participation in the contest constitutes winner’s consent to Sponsor to use winner’s name, likeness, opinions, biographical information, hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. If the winner does not respond within 30 days of Sponsor’s attempted e-mail notification or if the selected winner is ineligible or otherwise fails to properly claim the Prize, the prize will be forfeited.
DISCLAIMER
By entering this contest, participants agree to waive any right to claim any ambiguity or error in these Official Rules, or the contest itself, and agree to be bound by these Official Rules and by all decisions of the Sponsor, whose decisions are final. Participants agree that the Industry Standard, its affiliated companies, parent company, and any co-Sponsors of the Winning Predictions Contest shall not be liable for losses or injuries of any kind resulting from acceptance or use of Prize, participation in the contest, or any technical malfunctions of any kind, including but not limited to: the telephone network, computer on-line system, computer equipment, software, or any combination thereof, or any misdirected entries, or delayed data transmissions. NOTWITHSTANDING THE FOREGOING, UNDER NO CIRCUMSTANCES SHALL THE ABOVE REFERENCED ENTITIES BE LIABLE FOR AN AMOUNT OF DAMAGES IN EXCESS OF THE VALUE OF THE PRIZE(S) AWARDED HEREUNDER, NOR FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES. The Prize shall be provided on an "AS-IS" basis without warranty, guaranty or representation of any kind express or implied, including without limitation any implied warranty of merchantability, fitness for a particular purpose, or usability by a winner. IT IS PARTICIPANT’S RESPONSIBILITY TO READ AND UNDERSTAND ALL INFORMATION THAT MAY ACCOMPANY THE PRIZE.
Direct Menswear reserves the right to modify, suspend, or terminate the online entry forms for the Giveaway in the event that the Giveaway is technically impaired or corrupted, and in such event to select winners for any remaining prizes through a drawing from among all valid entries received. In the event of a dispute regarding the identity of the Particpant who submitted an online entry, the entry will be deemed submitted by the registered holder of the e-mail account.
GOVERNING LAW; ALTERNATIVE DISPUTE RESOLUTION
Participant agrees that any dispute arising out of this contest shall be resolved individually without class action and exclusively governed by and construed in accordance with the laws of the Commonwealth of Virginia without regard to its conflict of laws or rules. Any disputes (excluding disputes where a party is seeking preliminary or permanent injunctive relief or a temporary restraining order) that may arise out of this contest shall first be submitted to mediation before a mediator pursuant to the rules of mediation.
